TERZANI s.r.l. with its registered office in 50018 Scandicci (Florence), Via di Castelpulci int. 9, p. VAT number 03671100489 in the exercise of its design, design and production of interior lighting systems, collects personal data it processes in full compliance with European Regulation no. 679/2016 (hereinafter, for brevity: GDPR) and, in compliance with the regulations contained therein.

This Policy Statement provides all the information on the processing of personal data and on the rights pertaining to the data subject. Therefore, before giving consent to the processing of data, we therefore invite you to carefully read the information. To this end, it is specified that the Information is provided for the TERZANI s.r.l. website and not for other websites that may be consulted by the user via links. Indeed, possible other links to other websites have no connection with the site www.terzani.com, therefore, TERZANI s.r.l. disclaims any responsibility for these websites and their contents even from the point of view of protecting the privacy and processing of users' personal data. The presence of any links to other websites is made for the sole purpose of facilitating the user in searching and browsing.

1. Data Controller

The data controller (that is to say the person in charge of the decisions regarding the purpose, the methods of processing personal data, the security and the tools used) is TERZANI s.r.l., with its registered headquarters in Scandicci Via di Castelpulci int. 9, VAT number 03671100489, in the person of its legal representative Mr. Sergio Terzani.

2. Purposes of the processing and legal bases

The personal data of the data subject, that is the data provided by the subject who undertakes working relationships, that are commercially or otherwise connected with the business activity carried out by the Data Controller, are processed, also through their communication to third parties whenever necessary and instrumental, for the following purposes:

a) for purposes strictly connected and instrumental to the fulfillment of the obligations deriving from the contractual relationships established with the Data Controller for the administrative and accounting purposes connected and for the fulfillment of obligations established by the current legislation pursuant to Art. 6 b) GDPR;

b) to fulfill obligations, of any nature, provided for by laws, regulations, European Community regulations or in any case connected to obligations deriving from provisions issued by judicial authorities, administrative officials or police bodies, legitimated by law or by supervisory bodies and control pursuant to Article 6 c) GDPR;

c) for purposes related to asserting or defending a right in court by the Data Controller pursuant to art. 6 c) GDPR.

The authorization for the purposes referred to in points a), b) and c) above is mandatory; the refusal could make it impossible for the Data Controller to provide the services and/or execute the obligations arising from the established relationships. The relative processing finds its legal basis in the consent of the Data Subject manifested through the stipulation of the contract.

The processing, moreover, satisfies the legitimate interests of the Data Controllers such as the execution of the contract, invoicing, the collection of debts.

It shall, instead, to be considered merely optional, and therefore the possible refusal shall not be an impediment to providing the services provided by the Data Controller, to consenting to the processing of one's data for the following different purposes, functional to the activity of Data Controller pursuant to art. 6 a) GDPR:

d) for marketing and/or promotional purposes in an automated form (newsletter or dedicated newsletter, SMS,MMS, e-mail, fax) or in traditional form (post, telephone contact);

e) for communication to third party companies with consequent processing by these, who may use them for marketing and/or promotional purposes;

f) for own profiling and/or analysis activities related to market and/or statistical surveys.

The related treatment finds its own legal basis in the consent of the Data Subject, freely expressed after having read the Information. Consent can also be expressed through spontaneous registration and/or spontaneous sending of the completed form in the Newsletter section of the site.

3. Personal Data

Personal data are considered, pursuant to and for the purposes of Art. 9 GDPR, as the "...Processing of personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person's sex life or sexual orientation shall be prohibited."

TERZANI s.r.l. does not collect personal data. Should this become necessary, these will be treated exclusively following specific and explicit expressions of consent by the Data Subject, issued in writing, pursuant to and for the purposes of Art. 9, paragraph 2a) of the GDPR.

4. Methods and Place of Processing

The personal data of the Data Subjects collected for the purposes directly connected to the provision of the services provided, shall be processed by the employees and collaborators of the Data Controller, both internal and external, who have been formally appointed in accordance with Art. 4 of the GDPR as persons formally authorized to carry out the processing of personal data.

The processing of the same can be carried out by means of manual, computerised and/ or telematics systems, including automated systems, in compliance with the rules and principles of lawfulness and correctness, through the most suitable methods to guarantee their security and confidentiality; they will be communicated to third parties only where strictly necessary.

TERZANI s.r.l. collects personal data and other information directly from its users, including as part of users' online registration processes at www.terzani.com. Users are warned that the computer systems and software procedures of the website may collect, some personal data whose transmission is functionally connected in the use of electronic communications via the Internet during their normal operations. This information, which derives from the parameters relating to the user's computer environment, is not collected in order to be associated with identified subjects; nonetheless, through associative procedures with data, also held by third parties, it might allow the identification of users (for example: IP addresses, the method used to submit the request to the server, the size of the file obtained in response etc.). These data may only be used to verify the correct functioning of the site and are immediately deleted after processing, except for the possible need to ascertain the possibility of a computer crime against TERZANI s.r.l. Furthermore, in the context of the use of the site and the navigation within it the software uses automatic data collection systems, such as the so-called cookies, which, although they do not contain intelligible information, may allow the user to associate the personal information released by the same on the site. The user shall always retain the right to activate the cookie erasure procedure; however, in this case, as cookies might be necessary for the site to function properly, TERZANI s.r.l. does not guarantee the complete display of all web pages or the provision of some services. Neither is the correct display of all web pages guaranteed in the case of blocked popups or a failure to enable languages or other necessary procedures disabled by the user. Users are informed that should they disclose the personal data of third parties, they are obliged to obtain the consent to the processing of personal data by third parties, as well as to inform them of the above rules. In any event, the user shall solely be the only person responsible for the communication of information and data relating to third parties in the absence of consent and for any illegitimate use of the data.

The processing operations connected to the web services of the website www.terzani.com take place at the registered office of TERZANI s.r.l. and at the Amazon Web Services (AWS) hosting server.

5. Communication to Third Parties and to the Transfer of Personal Data Outside the EU Area

The Data Controller, in compliance with all the provisions already provided for in the previous points, shall communicate the data of the data subjects to:

  • providers of banking services, consulting services, IT services, unless others, whose support the Data Controller may avail itself of in the performance of its own business;
  • third party subjects for the purpose of surveying the satisfaction of the quality of the services provided, and/or the processing market research, customer profiling.

The updated list of the persons in charge of processing and external managers shall be kept at the headquarters of the Data Controller.

Personal data shall not be transferred abroad.

6. Storage period of Storage of Personal Data and the Criteria Used

The personal data communicated by the data subject and those collected by the Data Controller shall be stored for the duration necessary for the provision of the services and for the next 10 years, unless the data subject requests, as he or she may at any time, the erasure of his data as shown below. In this case the data provided will be immediately erased, except for restrictions, or any obligations deriving from the exercise of rights during judicial proceedings, or at the request of the Supervisory Authority.

7. Rights of the Data Subject

The European Regulation 679/2016 recognizes the rights listed below, which the Data Subject can exercise as regards the Data Controller. Below you will find a complete extract of the articles of the Law that follow.

Requests about the rights and/or any information and requests for explanation that the Data Subject party needs may be forwarded by written request to the Data Controller, by ordinary mail to TERZANI s.r.l., 50018 Scandicci (FI) Via di Castelpulci int. 9, or by e-mail to the email address privacy@terzani.com.

7.1 Right of Access by the Data Subject

Art. 15 of the European Regulation allows you to obtain from the controller confirmation as to whether or not personal data concerning you are being processed and where in this case you can obtain access to the personal data.

7.2 Right to Rectification

Art. 16 of the European Regulation allows the Data Subject to obtain from the data controller without undue delay the rectification of inaccurate personal data concerning him or her. Taking into account the purposes of the processing, taking into account the purposes of the processing, the data subject shall have the right to have incomplete personal data completed, including by means of providing a supplementary statement.

7.3 Right to Erasure

Art. 17 of the European Regulation allows the data to have the right to obtain from the controller the erasure of personal data concerning him or her without undue delay and the controller shall have the obligation to erase personal data without undue delay where one of the grounds by the law exists.

7.4 Right to Restriction of Processing

Art. 18 of the European Regulation allows the data subject shall have the right to obtain from the controller restriction of processing whenever one of the hypotheses envisaged by the law applies.

7.5 Right to Data Portability

Art. 20 of the European Regulation grants the data subject the right to receive the personal data concerning him or her, which he or she has provided to a controller, in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided. Furthermore, it gives the Data Subject right to have the personal data transmitted directly from one controller to another, where technically feasible.

7.6 The Right to Object

Art. 21 of the European Regulation grants the right to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her which is based on point (e) or (f) of Article 6(1), including profiling based on those provisions.

7.7 Right to Withdraw Consent

Art. 7 of the European Regulation grants the data subject the right to withdraw his or her consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

7.8 Right to Lodge a Complaint with the Supervisory Authority

Art. 77 of the European Regulation, states that without prejudice to any other administrative or judicial remedy, every data subject shall have the right to lodge a complaint with a supervisory authority, in particular in the Member State of his or her habitual residence, place of work or place of the alleged infringement.

TERZANI s.r.l. con sede legale in 50018 Scandicci (FI), Via di Castelpulci int. 9, partita iva 03671100489 nell'esercizio della propria attività di progettazione, design e produzione di sistemi per l'illuminazione di interni, raccoglie dati personali che tratta nel pieno rispetto del Regolamento Europeo n. 679/2016 (di seguito, per brevità: GDPR) e, in ottemperanza alle normative in esso contenute.

Con la presente informativa si forniscono tutte le indicazioni sul trattamento dei dati personali e sui diritti spettanti all'Interessato. Prima di manifestare il consenso al trattamento dei dati, pertanto, La invitiamo a prendere attenta visione dell'Informativa. A tal fine, si precisa che l'Informativa è resa per il sito di TERZANI s.r.l. e non anche per altri siti web eventualmente consultati dall'utente tramite link. Eventuali links ad altri siti web non hanno infatti alcun collegamento con il sito www.terzani.com, quindi, TERZANI s.r.l. declina ogni responsabilità circa tali siti web ed il contenuto dei medesimi anche sotto il profilo della tutela della privacy e del trattamento dei dati personali degli utenti. La presenza di eventuali links ad altri siti web è effettuata al solo scopo di facilitare l'utente nella ricerca e nella navigazione.

1. Titolare del trattamento

Titolare (cioè la persona a cui competono le decisioni in ordine alla finalità, alla modalità del trattamento di dati personali, alla sicurezza e agli strumenti utilizzati) è TERZANI s.r.l., con sede in Scandicci Via di Castelpulci int. 9, partita iva 03671100489, in persona del legale rappresentante Sig. Sergio Terzani.

2. Finalità del trattamento e basi giuridiche

I dati personali dell'Interessato, cioè i dati forniti dal soggetto che intraprende rapporti di lavoro, commerciali o comunque connessi con l'attività di impresa svolta dal Titolare sono trattati, anche attraverso la comunicazione a terzi quando necessaria e strumentale, per le seguenti finalità:

a) per finalità strettamente connesse e strumentali all'esecuzione degli obblighi derivanti dai rapporti contrattuali instaurati con il Titolare per le finalità amministrativo - contabili connesse e per l'adempimento di obblighi previsti dalla normativa vigente ex art. 6 b) GDPR;

b) per adempiere obblighi, di qualunque natura, previsti da leggi, regolamenti, normative comunitarie o comunque connessi ad obblighi derivanti da disposizioni impartite da autorità giudiziarie, da funzionari amministrativi o da organi di polizia, a ciò legittimati dalla legge o da organi di vigilanza e controllo ex art 6 c) GDPR;

c) per finalità connesse a far valere o difendere un diritto in sede giudiziaria da parte del Titolare ex art. 6 c) GDPR.

L'autorizzazione per le finalità di cui ai punti a), b) e c) che precedono è obbligatoria; il rifiuto potrebbe comportare l'impossibilità per il Titolare di erogare i servizi e/o dare esecuzione agli obblighi nascenti dai rapporti instaurati. Il relativo trattamento trova la propria base giuridica nel consenso dell'Interessato manifestato attraverso la stipula del contratto.

Il trattamento, inoltre, soddisfa legittimi interessi del Titolare quali: l'esecuzione del contratto, la fatturazione, la riscossione dei crediti.

È da considerarsi, invece, meramente facoltativo, e dunque l'eventuale rifiuto non ostativo all'erogazione dei servizi forniti dal Titolare, il consenso al trattamento dei propri dati per le seguenti finalità diverse, funzionali all'attività del Titolare ex art. 6 a) GDPR:

d) per finalità di marketing e/o comunque promozionali in forma automatizzata (newsletter o newsletter dedicata, sms, mms, email, fax) o in forma tradizionale (posta, contatto telefonico);

e) per la comunicazione a società Terze, con conseguente trattamento da parte di queste, che potranno utilizzarli per finalità di marketing e/o comunque promozionali;

f) per attività di profilazione e/o analisi proprie correlate ad indagini di mercato e/o di tipo statistico.

Il relativo trattamento trova la propria base giuridica nel consenso dell'interessato, liberamente manifestato dopo aver preso visione dell'Informativa. Il consenso può essere manifestato anche attraverso la spontanea registrazione e/o lo spontaneo invio del form compilato nella sezione Newsletter del sito.

3. Dati particolari

Sono considerati dati particolari, ai sensi e per gli effetti dell'art. 9 GDPR, tutti i dati "...idonei a rivelare l'origine razziale ed etnica, le convinzioni religiose, filosofiche o di altro genere, le opinioni politiche, l'adesione a partiti, sindacati, associazioni od organizzazioni a carattere religioso, filosofico, politico o sindacale, nonché i dati genetici, dati biometrici intesi a identificare in modo univoco una persona fisica, dati relativi alla salute o alla vita sessuale o all'orientamento sessuale della persona" dell'Interessato.

TERZANI s.r.l. non raccoglie dati particolari. Ove ciò dovesse rendersi necessario, questi saranno trattati esclusivamente in seguito a specifica ed esplicita manifestazione di consenso dell'Interessato, rilasciata per iscritto, ai sensi e per gli effetti dell'art. 9, co 2a) GDPR.

4. Modalità e luogo del trattamento

I dati personali degli Interessati raccolti per le finalità direttamente connesse all'erogazione dei servizi forniti, saranno trattati dai dipendenti e collaboratori del Titolare, sia interni che esterni, a ciò formalmente incaricati ai sensi dell'art. 4 GDPR quali persone formalmente autorizzate a compiere il trattamento dei dati personali.

Il trattamento dei medesimi potrà avvenire tramite sistemi manuali, informatici e/o telematici, anche automatizzati, nel rispetto delle norme e dei principi di liceità e correttezza, attraverso le modalità più idonee a garantirne la sicurezza e la riservatezza; essi saranno comunicati a terzi solo ove strettamente necessario.

TERZANI s.r.l. raccoglie direttamente dai propri utenti dati personali ed altre informazioni anche nell'ambito dei processi di registrazione online degli utenti al sito www.terzani.com. Gli utenti vengono avvisati che i sistemi informatici e le procedure software del sito possono acquisire nel corso del loro normale funzionamento alcuni dati personali la cui trasmissione è funzionalmente connessa nell'uso di comunicazioni telematiche via internet. Tali informazioni, che derivano dai parametri relativi all'ambiente informatico dell'utente, non sono raccolte per essere associate a soggetti identificati; tuttavia attraverso procedure associative con dati, anche detenuti da soggetti terzi, potrebbero permettere l'identificazione degli utenti (a titolo esemplificativo: gli indirizzi IP, il metodo utilizzato per sottoporre la richiesta al server, la dimensione del file ottenuto in risposta, etc.). Tali dati possono venir utilizzati solo per verificare il corretto funzionamento del sito e vengono immediatamente cancellati dopo l'elaborazione, salvo l'eventuale necessità di accertamento di ipotesi di reato informatico a danno di TERZANI s.r.l. Inoltre nell'ambito dell'uso del sito e della navigazione al suo interno il software utilizza sistemi automatici di raccolta dei dati, come i c.d. cookies, che pur non contenendo informazioni intelligibili possono consentire di associare l'utente alle informazioni personali rilasciate dallo stesso sul sito. L'utente ha sempre facoltà di attivare la procedura di cancellazione dei cookies; tuttavia, in tal caso, poiché i cookies possono essere necessari per il corretto funzionamento del sito, TERZANI s.r.l. non garantisce la completa visualizzazione di tutte le pagine web o la fornitura di alcuni servizi. La corretta visualizzazione di tutte le pagine web non è altresì garantita in caso di popup bloccati o di mancata abilitazione di linguaggi o di altre procedure necessarie disabilitate dall'utente. Gli utenti sono informati che qualora comunichino dati personali di terzi soggetti hanno obbligo di ottenere il consenso al trattamento dei dati personali da parte dei terzi, nonché di informare i medesimi delle norme che precedono. L'utente sarà in ogni caso il solo responsabile per la comunicazione di informazioni e di dati relativi a terzi soggetti in difetto di consenso e per l'eventuale uso illegittimo dei dati medesimi.

I trattamenti connessi ai servizi web del sito www.terzani.com hanno luogo presso la sede legale di TERZANI s.r.l. e presso il server di hosting di Amazon Web Services (AWS).

5. Comunicazione a terzi e trasferimento all'estero fuori dallo Spazio UE

Il Titolare, nel rispetto di tutto quanto già previsto ai punti precedenti, comunica i dati degli Interessati a:

  • ai fornitori di servizi bancari, servizi di consulenza, servizi informatici, salvo se altri, del cui supporto il Titolare può avvalersi nell'esercizio della propria attività;
  • soggetti terzi ai fini del rilevamento della di soddisfazione sulla qualità dei servizi erogati, e/o elaborazione di ricerche di mercato, profilazione di clientela.

L'elenco aggiornato degli incaricati del trattamento e dei responsabili esterni è custodito presso la sede del Titolare del trattamento.

I dati personali non sono trasferiti all'estero.

6. Periodo di conservazione dei dati personali e criteri utilizzati

I dati personali comunicati dall'Interessato e quelli raccolti dal Titolare saranno conservati per tutta la durata necessaria all'erogazione dei servizi e per i 10 anni successivi, salvo che l'Interessato richieda, come potrà fare in qualsiasi momento, la cancellazione dei suoi dati come sotto indicato. In tal caso i dati forniti saranno immediatamente cancellati, salvo limitazione, o obblighi derivanti dall'esercizio di diritti in sedi giudiziarie, o su richiesta di Autorità.

7. Diritti dell'Interessato

Il Regolamento Europeo 679/2016 Le riconosce i diritti di seguito elencati, che l'Interessato può esercitare nei confronti del Titolare del trattamento. A seguire troverà un estratto completo degli articoli di Legge che seguono.

Le richieste circa i diritti e/o ogni qualsiasi informazione e richiesta di spiegazione di cui l'Interessato avesse bisogno potranno essere inoltrate mediante richiesta scritta al Titolare del trattamento dei dati, con posta ordinaria all'indirizzo TERZANI s.r.l., 50018 Scandicci (FI) Via di Castelpulci int. 9, oppure con posta elettronica all'indirizzo email privacy@terzani.com.

7.1 Diritto di Accesso

L'art. 15 del Regolamento Europeo Le consente di ottenere dal Titolare del trattamento la conferma che sia o meno in corso un trattamento dati che La riguarda ed in tal caso di ottenere l'accesso a tali dati.

7.2 Diritto di Rettifica

L'art. 16 del Regolamento Europeo Le consente di ottenere dal Titolare del trattamento la rettifica dei dati personali inesatti che la riguardano senza ingiustificato ritardo. Tenuto conto delle finalità del trattamento, l'Interessato ha il diritto di ottenere l'integrazione dei dati personali incompleti, anche fornendo una dichiarazione integrativa.

7.3 Diritto di Cancellazione

L'art. 17 del Regolamento Europeo Le consente di ottenere dal Titolare del trattamento la cancellazione dei dati personali che La riguardano senza ingiustificato ritardo se sussiste uno dei motivi previsti dalla norma.

7.4 Diritto di Limitazione

L'art. 18 del Regolamento Europeo Le consente di ottenere dal Titolare del trattamento la limitazione del trattamento quando ricorre una delle ipotesi previste dalla norma.

7.5 Diritto alla Portabilità dei Dati

L'art. 20 del Regolamento Europeo Le consente di ricevere in un formato strutturato, di uso comune e leggibile da dispositivo automatico i dati personali che La riguardano forniti a un Titolare del trattamento e ha il diritto di trasmettere tali dati a un altro Titolare del trattamento senza impedimenti da parte del Titolare del trattamento cui li ha forniti. Inoltre, Le consente di ottenere la trasmissione diretta dei dati personali da un Titolare del trattamento all'altro, se tecnicamente fattibile.

7.6 Diritto di Opposizione

L'art. 21 del Regolamento Europeo Le consente di opporsi in qualsiasi momento, per motivi connessi alla sua situazione particolare, al trattamento dei dati personali che La riguardano ai sensi dell'articolo 6, paragrafo 1, lettere e) o f), compresa la profilazione sulla base di tali disposizioni.

7.7 Diritto di Revoca del Consenso

L'art. 7 del Regolamento Europeo Le consente di revocare il consenso prestato in qualsiasi momento. La revoca del consenso non pregiudica la liceità del trattamento basata sul consenso prima della revoca.

7.8. Diritto di Reclamo

L'art. 77 del Regolamento Europeo, qualora l'Interessato ritenga che il trattamento che lo riguarda violi il Regolamento, riconosce il diritto di proporre reclamo a un'autorità di controllo, segnatamente nello Stato membro in cui lo stesso risiede abitualmente, lavora oppure del luogo ove si è verificata la presunta violazione.
